Warranties against construction defects in the Grand Duchy of Luxembourg

The sums set aside by a family to become homeowners are very often a lifetime's investment. Whilst Luxembourg law provides for a consumer protection regime, the complex implementation of statutory warranties gives rise to a significant amount of litigation. This book aims to provide an overview of the main difficulties that arise in relation to warranties against hidden defects in contracts for the supply of works and sales contracts. The first part is devoted to the nature of the statutory guarantee, depending on the defect and the contractual relationship (sale or contract for work). In the second part, the statutory guarantee regime is examined from a practical perspective, covering issues such as the acceptance of works and guarantee periods. Finally, continuing in the same vein, the third part is devoted to the practical aspects relating to the identification of defects through judicial expert reports and the principles of redress, whether in kind or by equivalent.
